Welcome to Queenwood Property. These Terms and Conditions govern your use of our website and outline the basis on which we provide our estate agency services. By using our website or engaging with us, you agree to these Terms and Conditions.
1. Introduction
These Terms and Conditions set out the basis on which QW Property Partners Ltd (company number 16749742), trading as Queenwood Property, acts as an estate agent in relation to the off-market sale of residential property. By engaging our services, you agree to these Terms and Conditions.
Queenwood Property operates from: 71–75 Shelton Street, Covent Garden, London WC2H 9JQ.
2. Scope of Service
Queenwood Property acts as an estate agent for clients wishing to sell their property on an off-market basis. Properties are introduced to specifically matched buyers and are not advertised on property portals, social media channels, or public marketing platforms.
All viewings are accompanied, and selected buyers may be provided with access to private online property details via a secure access code.
3. Agency Basis
Our service operates on a non-sole agency basis:
Clients may instruct other estate agents if they choose.
To maintain the integrity of the off-market approach, we request that the property is not openly advertised while we are making introductions.
No minimum term applies, and the agreement may be ended at any time by written notice.
Our fee becomes payable if we introduce a buyer who subsequently proceeds to exchange contracts, even if another agent is involved.
A viewing conducted through Queenwood Property constitutes an introduction.
4. Commission Fee
Our commission fee is 1% of the final sale price plus VAT.
The fee is calculated on the price agreed between seller and buyer.
The fee becomes due upon exchange of contracts.
Payment is made upon completion and is typically settled through the seller’s solicitor from the sale proceeds.
5. No Sale, No Fee
If a sale is not achieved—meaning no exchange of contracts to a buyer introduced by Queenwood Property—no fee will be payable.
6. Marketing & Viewings
Queenwood Property will:
Market the property off-market only.
Not display a ‘For Sale’ board.
Provide secure digital access to property details for selected buyers.
Accompany all viewings and provide feedback within 48 hours where possible.
Clients agree to:
Allow reasonable access for photography and viewings.
Present the property in a clean and saleable condition.
7. Offers & Sale Progression
All offers will be communicated promptly.
We will obtain reasonable information to verify a buyer’s identity and financial position, though we cannot be responsible for inaccurate or incomplete information supplied by third parties.
Once an offer is accepted, we will liaise with solicitors and all parties involved to help progress the transaction, noting that the legal process is beyond our direct control.
8. Dual Fees Warning
Clients who have existing agreements with other estate agents may be liable to pay multiple fees. It is the client’s responsibility to understand the terms of any other agency agreements.
9. Liability for Fees Following Introduction
Queenwood Property’s full fee is payable if:
A buyer introduced by us purchases the property privately or through another agent.
A sale is agreed via another agent within 6 months of the property being withdrawn from our instruction.
A sale is agreed privately within 2 years of withdrawal to a buyer introduced by Queenwood Property.
An introduction includes any buyer who has viewed the property through us.
10. Withdrawal of Instructions
Clients may withdraw their property from sale at any time by confirming their decision in writing. Marketing will cease immediately upon receipt of written notice.
Queenwood Property may also withdraw from acting for the client by providing written notice.
11. Money Laundering Regulations
We are legally required to verify client identity and proof of ownership before commencing marketing activities. Clients must provide relevant documentation when requested.
12. Data Protection
Personal information is handled in accordance with data protection legislation.
Data is used solely for the purpose of marketing and selling the property unless consent is given for other uses.
13. Complaints Procedure
We are a member of The Property Ombudsman. Complaints should be submitted in writing to info@queenwoodproperty.co.uk
14. Governing Law
These Terms and Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
